Consumer Information
Information regarding the consumer’s right of withdrawal
Pursuant to Section 8:1, paragraph 1, point 3 of the Civil Code (Ptk.), only a natural person acting outside the scope of their profession, independent occupation, or business activity qualifies as a consumer; therefore, legal entities may not exercise the right of withdrawal without providing a reason!
Under Section 20 of Government Decree 45/2014 (II. 26.), a consumer is entitled to a right of withdrawal without providing a reason. The consumer may exercise this right of withdrawal:
a) In the case of a contract for the sale of goods:
aa) from the date of receipt of the goods;
ab) in the case of a contract for the sale of multiple goods, where the goods are delivered at different times, from the date of receipt of the last item delivered;
ac) in the case of goods consisting of multiple lots or pieces, from the date of receipt of the last lot or piece;
ad) in the case of a contract for the regular delivery of goods over a defined period, from the date of receipt of the first delivery;
The right may be exercised within a period of 14 calendar days, calculated from the date on which the goods are received by the consumer or by a third party designated by the consumer (other than the carrier).
The provisions herein do not affect the consumer’s right to exercise the aforementioned right of withdrawal during the period between the conclusion of the contract and the receipt of the goods. If the consumer has made an offer to conclude the contract, the consumer has the right to withdraw that offer before the contract is concluded; such withdrawal terminates the consumer’s obligation to be bound by the offer.
If the Seller has failed to inform the consumer regarding the deadline and other conditions for exercising the right of withdrawal (specifically those set out in Section 22 of the Government Decree), or has failed to provide the model withdrawal form (as per Annex 2), the withdrawal period mentioned above shall be extended by 12 months. If the Seller provides the consumer with the required information regarding the right of withdrawal within 12 months of the expiry of the original withdrawal period, the period available for withdrawal or termination shall expire 14 days from the date the consumer receives such information.
Government Decree 45/2014 (II. 26.) on the detailed rules for contracts between consumers and businesses can be accessed here.
Declaration of Withdrawal; Exercise of the Consumer’s Right of Withdrawal or Termination
The consumer may exercise the right granted under Section 20 of Government Decree 45/2014 (II. 26.) by means of an unequivocal statement to that effect—either by using a template declaration (available for download from the website) or by utilizing the withdrawal function.
The Withdrawal Function
The withdrawal function is an online declaration of withdrawal through which the consumer may inform the business of their decision to withdraw from the contract. This includes providing their name, details identifying the contract from which they are withdrawing, and information regarding the electronic device through which they wish to receive confirmation of the withdrawal.
The withdrawal function can be accessed on the Website via the link labeled “Withdrawal from the contract” (“Elállás a szerződéstől”). The consumer may submit the online declaration of withdrawal to the Seller by using the confirmation function labeled “Confirmation of withdrawal” (“Elállás megerősítése”).
Upon becoming aware of the withdrawal, the Seller shall, without undue delay, send an acknowledgment of receipt to the consumer on a durable medium. This acknowledgment shall include the content of the withdrawal, as well as the date and time of its submission.
The online withdrawal function is available on the Website at the following location: https://account.marovialiving.com/orders.
Validity of the Consumer’s Declaration of Withdrawal
The right of withdrawal shall be considered exercised within the time limit if the consumer sends their declaration within that period.
In the case of withdrawal or termination in writing, it is sufficient to send the declaration of withdrawal or termination within the time limit.
The burden of proving that the right of withdrawal was exercised in accordance with this provision lies with the consumer.
Upon receipt of the consumer’s declaration of withdrawal, the Seller is obliged to provide confirmation thereof on an electronic data carrier.
Obligations of the Seller in the Event of a Consumer’s Withdrawal
The Seller’s Obligation to Refund
If a consumer withdraws from the contract in accordance with Section 22 of Government Decree 45/2014 (II. 26.), the Seller shall, within fourteen days of becoming aware of the withdrawal, refund the total amount paid by the consumer as consideration, including any costs incurred in connection with the performance of the contract, such as delivery charges. Please note that this provision does not apply to any additional costs resulting from the consumer’s choice of a delivery method other than the least expensive standard delivery method offered.
Method of the Seller’s Refund Obligation
In the event of a withdrawal or termination pursuant to Section 22 of Government Decree 45/2014 (II. 26.), the Seller shall refund the amount due to the consumer using the same payment method as that used by the consumer for the original transaction. With the consumer’s express consent, the Seller may use a different payment method for the refund, provided that the consumer does not incur any additional charges as a result. The Seller shall not be held liable for any delays resulting from a bank account number or postal address provided incorrectly and/or inaccurately by the consumer.
Additional Costs
If the consumer explicitly chooses a mode of delivery other than the least expensive standard mode of delivery offered, the Seller is not required to reimburse the resulting additional costs. In such cases, our obligation to reimburse is limited to the amount of the standard delivery charges.
Right of Retention
The Seller may withhold the amount due to the consumer until the consumer has returned the Goods or has provided unequivocal proof that they have been sent back; whichever occurs first. We are unable to accept shipments sent via cash-on-delivery (COD) or with postage due.
Consumer’s Obligations in the Event of Withdrawal or Termination
Return of Goods
If the consumer withdraws from the contract in accordance with Section 22 of Government Decree 45/2014 (II. 26.), they must return the Goods—or hand them over to the Seller or a person authorized by the Seller to receive them—without undue delay and no later than fourteen days from the date the withdrawal is communicated. The return is considered timely if the consumer dispatches the Goods before the deadline expires.
Goods subject to withdrawal must be returned to the following address:
Name of the Seller: Kovács Attila e.v. (sole proprietor)
Return address: Depends on the supplier.
Bearing the direct costs of returning the goods
The consumer shall bear the direct costs of returning the goods. The goods must be returned to the address provided by the Seller above. If the Seller also sells the goods at a physical retail location, and the consumer exercises their right of withdrawal in person at said location, they are entitled to return the goods to the business at the same time. If, following the commencement of performance, the consumer terminates a contract for the provision of services—concluded off-premises or via distance means—they are obliged to pay the business a fee proportional to the services provided up to the time the termination is communicated to the business. The proportional amount payable by the consumer shall be determined based on the total consideration stipulated in the contract (inclusive of tax). If the consumer proves that the total amount determined in this manner is excessively high, the proportional amount shall be calculated based on the market value of the services provided up to the time of the contract's termination. Please note that we are unable to accept goods returned via cash-on-delivery (COD) or with postage due.
Consumer’s liability for diminished value
The consumer is liable for any diminished value of the goods resulting from handling that goes beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
The right of withdrawal cannot be exercised in the following cases:
The Seller expressly draws your attention to the fact that you may not exercise your right of withdrawal in the cases set out in Section 29(1) of Government Decree 45/2014 (II. 26.):
-
after the service has been fully performed; however, if the contract imposes a payment obligation on the consumer, this exception shall only apply if performance began with the consumer’s express prior consent and the consumer acknowledged that they would lose their right of withdrawal once the business had fully performed the contract;
-
in the case of Goods or services the price or fee of which depends on fluctuations in the financial market that are beyond the control of the business and may occur during the withdrawal period;
-
in the case of non-prefabricated Goods produced according to the consumer’s instructions or at their express request, or in the case of Goods that are clearly personalized for the consumer;
-
in the case of Goods that are perishable or liable to deteriorate or expire rapidly;
-
in the case of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery (please be advised that for such sealed goods, any use beyond what is necessary to establish the nature, characteristics, and functioning of the goods will result in the loss of the right of withdrawal);
-
in the case of goods which, by their nature, are inseparably mixed with other items after delivery;
-
in the case of alcoholic beverages where the actual value depends on market fluctuations beyond the trader’s control, and where the price was agreed upon at the time of the conclusion of the sales contract, but delivery is scheduled to take place more than thirty days after the conclusion of the contract;
-
in the case of service contracts where the trader has visited the consumer at the consumer’s express request for the purpose of carrying out urgent repairs or maintenance;
-
in the case of the sale of sealed audio or video recordings or sealed computer software, if the consumer has unsealed the packaging after delivery;
-
in the case of newspapers, periodicals, or magazines, with the exception of subscription contracts;
-
in the case of contracts concluded at a public auction;
-
in the case of contracts for the provision of accommodation (other than for residential purposes), transport, car rental, catering, or services related to leisure activities, where a specific date or period for performance has been stipulated in the contract;
-
in the case of digital content not supplied on a tangible medium, where the Seller has commenced performance with the consumer’s express prior consent, and the consumer has, at the same time as providing such consent, acknowledged that they will lose their right of withdrawal once performance has begun, and the business has provided a confirmation to the consumer.

Matterhorn
Complaints - when the buyer receives a defective product
All products sold by the Merchant have a manufacturer's warranty. The Buyer shall return the product at his own expense to Matterhorn's address: Grupa Modne Zakupy Sp. z o.o., ul. Słowiańska 6, 75-846 Koszalin, Poland. The Seller forwards the product to the Manufacturer. The time for considering complaints depends solely on the Manufacturer. More information on the warranty conditions of different brands can be found in the warranty certificates or on the Manufacturer's websites.
Pursuant to Article 558 § 1 of the Civil Code of the Republic of Poland, the Seller's warranty liability for defects in goods is excluded. This means that any further complaint procedure is a matter between the Manufacturer and the Buyer.
Complaints - what if we make a mistake?
Matterhorn is responsible for errors in sending the order. In this case, please return the product to the Matterhorn wholesaler. After receiving the product, we will resend the correct product to the specified address at Matterhorn's expense.
Complaints - if a package arrives at an incorrect address
The goods will be sent to the destination address you provided. We make every effort to verify the correctness of the addresses provided in advance and often ask you to double-check them if we have any doubts about their correctness. In the event that the destination address turns out to be incorrect and the package is returned to us, we are only responsible for this situation if there was an error on our part when providing the address details to the courier. If the package is returned due to an incorrect address or if the customer did not pick it up, we will charge a €5 return fee. This amount must be paid by Matterhorn to the courier companies for the return of the package.
